Please read these Terms of Service and Terms and Conditions carefully before requesting, approving, scheduling, or receiving services from 3 Brother's Plumbing and Heating, located at 3 Virginia Rd, Montana City, MT 59634. These terms apply to residential, commercial, and property-management customers who contact, hire, authorize, or otherwise engage 3 Brother's Plumbing and Heating for plumbing, heating, air conditioning, drain, fixture, equipment, repair, installation, maintenance, diagnostic, emergency, or related contractor services.

By requesting an estimate, booking an appointment, approving work, signing a proposal, submitting payment, communicating with us, or allowing our technicians to begin work, you agree to these Terms of Service. If you do not agree, please do not authorize service.

These terms are intended to provide clear expectations for plumbing and heating service in Montana. They are not intended to replace a written estimate, invoice, financing agreement, manufacturer warranty, heating service agreement, maintenance plan, or other signed document. If a signed written agreement conflicts with these terms, the signed agreement will control for that specific service.

Acceptance of terms

You accept these terms when you do any of the following:

  • Request service, an estimate, a quote, or a consultation

  • Schedule an appointment by phone, website, text message, email, online form, or third-party platform

  • Sign an authorization, proposal, invoice, work order, financing document, or service agreement

  • Permit 3 Brother's Plumbing and Heating or its technicians to access the property

If you are scheduling service on behalf of another person, business, property owner, tenant, landlord, association, or property manager, you represent that you have authority to do so and to bind that party to these terms.

Scope of Services

3 Brother's Plumbing and Heating may provide plumbing, heating, air conditioning, HVAC, fixture, equipment, maintenance, diagnostic, repair, replacement, installation, inspection, drain, piping, water heater, boiler, furnace, thermostat, ventilation, and related services as offered by the company from time to time.

The exact scope of work will be described in the applicable estimate, work order, proposal, invoice, service ticket, maintenance plan, or heating service agreement. Unless clearly included in writing, services do not include unrelated repairs, hidden conditions, code upgrades, finish restoration, structural work, electrical upgrades, remediation, engineering, architectural services, asbestos or mold abatement, or other work outside the stated scope.

3 Brother's Plumbing and Heating may decline, stop, postpone, or limit service when conditions are unsafe, access is inadequate, required approvals are missing, payment issues exist, parts are unavailable, or the requested work is outside our licensing, capabilities, service area, or business policies.

Estimates, quotes, and diagnostics

Estimates are based on the information available at the time they are prepared. Plumbing, heating, and air conditioning systems may involve hidden conditions, concealed piping, inaccessible equipment, prior repairs, code issues, age-related deterioration, manufacturer limitations, and conditions that are not visible until work begins.

Unless stated otherwise in writing:

  • Estimates are not a guarantee of final cost.

  • Diagnostic fees, service call fees, trip charges, dispatch fees, after-hours fees, and inspection fees may apply.

  • Estimates may expire after the time period stated on the estimate or, if no period is stated, after a reasonable time.

  • Pricing may change due to parts availability, supplier pricing, equipment changes, additional labor, hidden conditions, customer-requested changes, permit requirements, or scope changes.

  • Verbal estimates are preliminary and subject to written confirmation.

  • A technician's diagnosis is based on symptoms and observations at the time of service.

Approval of an estimate authorizes 3 Brother's Plumbing and Heating to proceed with the described work and to order parts, allocate labor, schedule technicians, obtain materials, and perform related administrative tasks.

Scheduling and Dispatch

Appointments are scheduled based on technician availability, service area, job type, urgency, weather, road conditions, parts availability, customer access, and other operational factors. Appointment windows are estimates, not guarantees.

3 Brother's Plumbing and Heating may use ServiceTitan or other tools for scheduling, dispatch, invoicing, customer communications, estimates, service records, job notes, technician assignments, payment tracking, and recordkeeping. Information entered into ServiceTitan may help us coordinate service, document customer authorizations, send appointment reminders, manage invoices, and maintain job history.

We will make reasonable efforts to arrive within the scheduled service window. However, plumbing, heating, and air conditioning work can involve emergency calls, prior appointments that take longer than expected, traffic, weather, supply delays, and safety concerns. We may contact you to update, reschedule, or adjust the appointment as needed.

Cancellations, rescheduling, and missed appointments

Customers should provide as much notice as possible when canceling or rescheduling. Because service appointments require technician time, dispatch coordination, vehicle allocation, and administrative preparation, cancellation fees, trip charges, or missed appointment fees may apply when:

  • You cancel after a technician has been dispatched

  • You are not present or available during the appointment window

  • The technician cannot access the property, equipment, utility room, roof, crawlspace, mechanical area, locked gate, or tenant space

  • Required approvals, keys, pets, parking, or responsible adults are not available

  • The work area is unsafe or not ready for service

  • You postpone work after parts, materials, or equipment have been ordered

Special-order parts, custom equipment, permits, design work, administrative fees, restocking fees, and deposits may be nonrefundable unless otherwise required by law or stated in writing.

Customer access and site readiness

You are responsible for providing safe, reasonable, and timely access to the property and all areas required for service. This may include access to plumbing fixtures, shutoff valves, water heaters, boilers, furnaces, air conditioning equipment, electrical panels, mechanical rooms, crawlspaces, attics, roofs, basements, yards, utility areas, drains, cleanouts, and exterior equipment.

Before our arrival, please make sure:

  • A responsible adult or authorized representative is available if needed.

  • Pets are secured away from the work area.

  • Vehicles, stored items, furniture, snow, debris, or obstacles are moved as needed.

  • Water, gas, electricity, internet, and other utilities are available unless the service requires shutoff.

  • Access codes, keys, gate instructions, parking instructions, and tenant approvals are provided.

  • The work area is reasonably clean, lit, and safe.

  • Known hazards are disclosed before work begins.

If the site is not ready or accessible, we may reschedule the appointment and charge applicable fees.

Customer responsibilities

Customers are responsible for accurate information, timely decisions, and cooperation during service. You agree to:

  • Provide truthful and complete information about the issue, equipment, property, and service history

  • Disclose known leaks, backups, electrical problems, gas concerns, hazardous materials, structural issues, mold, asbestos, pests, contamination, or unsafe conditions

  • Obtain landlord, tenant, property manager, association, or owner approvals when required

  • Keep children, pets, visitors, and unauthorized persons away from work areas

  • Follow technician safety instructions

  • Maintain equipment after service according to manufacturer instructions and recommended maintenance

  • Monitor plumbing, heating, and air conditioning systems after service and promptly report concerns

  • Pay all amounts due according to the invoice, estimate, financing agreement, or service agreement

Failure to meet customer responsibilities may affect scheduling, warranty eligibility, service outcomes, pricing, and liability.

Work authorization and change orders

You authorize 3 Brother's Plumbing and Heating to perform the work described in the approved estimate, proposal, work order, or service ticket. If additional work is needed, we may request approval for a change order, revised estimate, or additional invoice.

Change orders may be required for:

  • Hidden or concealed damage

  • Code-required upgrades

  • Deteriorated piping, wiring, fixtures, valves, drains, ducts, or equipment

  • Customer-requested additions or substitutions

  • Additional troubleshooting beyond the original diagnostic scope

  • Repairs required to complete the original work safely

  • Permit, inspection, or utility requirements

  • Material or equipment substitutions caused by availability

Approval may be provided in writing, electronically, verbally, by text message, by email, through ServiceTitan CRM, by signature, by payment, or by allowing work to continue.

Payment terms

Payment is due as stated on the estimate, invoice, financing document, heating service agreement, or service plan. Unless otherwise agreed in writing, payment is due on-site at time of work.

3 Brother's Plumbing and Heating may require:

  • Service call fees

  • Diagnostic fees

  • Dispatch or trip charges

  • Deposits for equipment, parts, permits, or scheduled work

  • Progress payments for larger projects

  • Payment in full at completion

  • Payment authorization before after-hours or emergency service

  • Approved financing before work begins

Accepted payment methods may vary and may include cash, check, card, electronic payment, financing, or other methods offered by the company. Returned checks, failed payments, chargebacks, late payments, declined cards, or unpaid invoices may result in additional fees, suspension of service, collections activity, cancellation of appointments, loss of promotional pricing, or enforcement of lien rights where permitted by Montana law.

Financing

Financing may be offered through third-party lenders or financing providers when available. Financing approval is not guaranteed and may depend on creditworthiness, lender requirements, available programs, documentation, and other factors.

If you choose financing:

  • You are responsible for reviewing and agreeing to the lender's terms.

  • The financing agreement is separate from these Terms of Service.

  • 3 Brother's Plumbing and Heating is not responsible for a lender's approval decision, interest rate, fees, payment schedule, credit reporting, or account servicing.

  • Work may not begin until financing is approved and all required documents are completed.

  • If financing is denied, delayed, canceled, or reversed, you remain responsible for payment by another accepted method.

Promotional financing, deferred interest, rebates, or special offers may be subject to separate eligibility requirements and expiration dates.

Collections, late payments, and lien rights

If amounts owed are not paid when due, 3 Brother's Plumbing and Heating may take lawful steps to collect payment. These steps may include sending reminders, assessing late fees where allowed, suspending further service, referring the account to collections, recovering collection costs, seeking attorney fees where permitted, filing a claim, and exercising construction lien, mechanic's lien, or other lien rights as permitted by applicable Montana law.

By authorizing work, you acknowledge that unpaid labor, materials, equipment, services, or improvements to real property may create lien rights in favor of contractors, subcontractors, suppliers, or other parties where allowed by law. You agree to cooperate with reasonable payment documentation, owner information, job records, and notices related to lien rights.

Nothing in these terms waives any rights, remedies, notices, deadlines, defenses, or procedures provided by Montana law.

Permits, codes, and inspections

Some plumbing, heating, and air conditioning work may require permits, inspections, utility coordination, or compliance with applicable codes. Unless a written estimate states otherwise, permit fees, inspection fees, utility fees, engineering, drawings, code upgrades, and related costs may be billed separately.

3 Brother's Plumbing and Heating may assist with permit coordination when included in the scope of work. However, customers remain responsible for providing property information, owner authorization, access for inspectors, association approvals, landlord approvals, utility access, and timely decisions needed for permitting or inspection.

If an inspector, utility, authority, manufacturer, or code requirement results in additional work, modifications, or delays, you agree to pay for approved additional work and related costs. 3 Brother's Plumbing and Heating is not responsible for pre-existing noncompliance, unpermitted prior work, concealed defects, or code issues unrelated to the scope of services we agreed to perform.

Safety and hazardous conditions

Safety is a priority. We may refuse, stop, or postpone service if conditions are unsafe or potentially unsafe. This includes, but is not limited to:

  • Gas leaks or suspected combustion hazards

  • Electrical hazards

  • Structural instability

  • Unsafe ladders, roofs, crawlspaces, attics, or confined spaces

  • Sewage exposure, biological hazards, chemicals, mold, asbestos, lead, pests, or contamination

  • Aggressive animals or unsafe occupants

  • Weather, ice, snow, flooding, poor lighting, or road conditions

  • Threatening, abusive, discriminatory, or harassing behavior

If hazardous materials or unsafe conditions are discovered, you may be responsible for hiring properly licensed specialists, remediation contractors, electricians, engineers, roofers, restoration providers, or other professionals before we can continue. We may charge for time spent identifying, documenting, or responding to unsafe conditions.

Property damage and work-area impacts

Plumbing, heating, and air conditioning work can involve cutting, drilling, opening walls, moving equipment, accessing crawlspaces, draining systems, shutting off utilities, removing fixtures, handling old materials, or working around finished surfaces. While our technicians strive to work carefully, some disturbance may be unavoidable.

Unless specifically included in writing, 3 Brother's Plumbing and Heating is not responsible for cosmetic restoration, drywall repair, painting, flooring repair, cabinetry repair, landscaping repair, tile replacement, concrete repair, roof repair, trim repair, finish carpentry, or restoration work needed to access, diagnose, repair, or replace plumbing, heating, or air conditioning systems.

We are not responsible for damage caused by pre-existing conditions, hidden defects, brittle or aged materials, improper prior installation, corrosion, frozen lines, high water pressure, failed valves, clogged drains, deteriorated seals, unavailable shutoffs, customer-supplied parts, or systems that fail during reasonable service efforts.

Please remove valuable, fragile, sentimental, electronic, or sensitive items from the work area before service begins.

Emergency service

Emergency service may be available depending on technician availability, location, weather, parts, safety, and scheduling. Emergency, after-hours, weekend, holiday, urgent, or priority service may be subject to higher rates, dispatch charges, minimum fees, or special payment requirements.

Emergency service is intended to diagnose, stabilize, reduce damage, restore essential function when possible, or recommend next steps. Permanent repairs may require parts, permits, return visits, inspections, equipment replacement, or additional work.

3 Brother's Plumbing and Heating does not guarantee immediate availability, same-day completion, or full restoration during emergency calls. Customers remain responsible for taking reasonable steps to protect property, including shutting off water or gas if safe, turning off equipment if instructed, contacting emergency authorities when necessary, and arranging restoration or mitigation services when appropriate.

Warranties and workmanship

3 Brother's Plumbing and Heating may provide workmanship warranties for certain services as stated on the applicable invoice, estimate, proposal, or written warranty document. Manufacturer warranties for parts and equipment are provided by the manufacturer and are subject to the manufacturer's terms, registration requirements, exclusions, and procedures.

Warranty coverage may be void, limited, or denied if problems are caused by:

  • Lack of maintenance

  • Misuse, neglect, abuse, or unauthorized modification

  • Customer-supplied parts or equipment

  • Work performed by others

  • Existing system defects or improper prior installation

  • Corrosion, freezing, water quality, power issues, fuel issues, drainage issues, or environmental conditions

  • Acts of God, weather, fire, flood, lightning, pests, or casualty events

  • Failure to follow operating instructions or recommended maintenance

  • Normal wear and tear

  • Hidden conditions not caused by our work

Warranty claims must be reported promptly. You must provide access for inspection and give 3 Brother's Plumbing and Heating a reasonable opportunity to evaluate and address alleged warranty issues before hiring another contractor. Payment disputes or unpaid invoices may delay or limit warranty service where permitted by law.

Disclaimers

Except as expressly stated in a written estimate, invoice, warranty, heating service agreement, or other signed document, services are provided without additional warranties, guarantees, or representations. To the fullest extent allowed by law, 3 Brother's Plumbing and Heating disclaims implied warranties, including implied warranties of merchantability, fitness for a particular purpose, uninterrupted operation, energy savings, system life expectancy, compatibility, and performance beyond the stated scope of work.

We do not guarantee that diagnostic work will identify every current or future issue, especially when systems are old, inaccessible, intermittent, modified, improperly installed, or affected by hidden conditions. We do not guarantee that repairs will extend the life of obsolete, deteriorated, poorly maintained, or failing systems.

Recommendations are based on professional judgment at the time of service and the information available to us. Customers are responsible for deciding whether to repair, replace, maintain, or discontinue use of equipment or systems.

Limitation of liability

To the fullest extent permitted by law, the liability of 3 Brother's Plumbing and Heating for any claim arising out of or related to services, estimates, scheduling, communications, equipment, materials, parts, delays, or these terms is limited to the amount paid by the customer for the specific service giving rise to the claim.

3 Brother's Plumbing and Heating will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or economic damages, including loss of use, loss of income, lost profits, business interruption, inconvenience, temporary housing, food spoilage, water damage progression, mold growth, loss of data, loss of comfort, lost rentals, or damages caused by delays, parts availability, utility issues, weather, emergency conditions, or third parties.

Some limitations may not apply where prohibited by law. Nothing in these terms limits liability that cannot legally be limited.

Customer-supplied parts and equipment

If you request installation of customer-supplied parts, fixtures, equipment, thermostats, valves, appliances, water heaters, faucets, or materials, 3 Brother's Plumbing and Heating may decline the work or limit warranty coverage. Customer-supplied items may be missing components, incompatible, defective, used, counterfeit, damaged, not code-compliant, or unsuitable for the property.

Unless otherwise stated in writing:

  • We do not warrant customer-supplied products.

  • Labor to install, remove, reinstall, diagnose, or replace customer-supplied products is billable.

  • Delays caused by missing or defective customer-supplied items may result in additional charges.

  • You are responsible for product returns, exchanges, warranty claims, and compatibility issues.

Maintenance plans and heating service agreements

If you enroll in a maintenance plan or service agreement, the plan terms will be described in the applicable agreement, invoice, membership document, or promotional materials. These may include scheduled maintenance, reminders, priority scheduling, inspection checklists, discounts, or other benefits.

Maintenance plans and heating service agreements do not guarantee that equipment will not fail, do not cover all repairs, and do not replace manufacturer requirements unless stated in writing. Benefits may be subject to account status, service area, scheduling availability, equipment condition, access, and plan limitations.

Plan fees, renewal terms, cancellation rights, transferability, covered equipment, exclusions, and discounts will be governed by the specific plan documents. If the plan documents conflict with these terms, the plan documents will apply to that plan.

Communications, SMS, email, and reminders

By contacting 3 Brother's Plumbing and Heating or providing your phone number, email address, or mailing address, you authorize us to contact you about scheduling, dispatch, estimates, service updates, technician arrival, invoices, payment reminders, maintenance reminders, warranty issues, follow-up, reviews, and related business communications.

Communications may be sent by phone, voicemail, text message, SMS, email, postal mail, online form, customer portal/ServiceTitan, or other communication tools we use. Message and data rates may apply. You are responsible for keeping your contact information current.

You may opt out of promotional text or email messages where required by law. Opting out of promotional messages will not prevent transactional messages related to appointments, invoices, safety, service updates, or account matters.

Please do not send sensitive personal, financial, medical, or confidential information by unsecured text message or email unless requested through a secure process.

Call recording and documentation

For quality assurance, training, scheduling accuracy, dispute resolution, safety, customer service, and recordkeeping, phone calls, voicemails, messages, in-person approvals, job notes, photos, videos, electronic signatures, estimates, invoices, and communications may be recorded, documented, stored, or associated with your customer profile where permitted by law.

Technicians may take photos or videos of equipment, work areas, model numbers, serial numbers, damage, access conditions, completed work, or safety issues for documentation, estimates, warranty records, internal review, or customer communication. We do not intend to photograph personal areas unrelated to the service. Please notify us before service if there are privacy-sensitive areas or restrictions we should know about.

Promotions, coupons, and discounts

These may include severe weather, road closures, fires, floods, supply chain delays, equipment shortages, manufacturer delays, labor shortages, illness, utility interruptions, permitting delays, inspection delays, fuel shortages, accidents, emergencies, acts of God, governmental actions, or unsafe conditions.

If delays occur, we will make reasonable efforts to communicate updates and reschedule work. Delays do not automatically entitle customers to discounts, damages, cancellation without cost, or priority over other scheduled work.

Third-party services and subcontractors

Some projects may require third-party services, subcontractors, suppliers, manufacturers, utilities, inspectors, engineers, restoration companies, excavation providers, electricians, roofers, or other specialists. 3 Brother's Plumbing and Heating may coordinate with third parties when appropriate, but we are not responsible for their independent acts, omissions, pricing, warranties, delays, or workmanship unless required by law or agreed in writing.

Manufacturer warranties, utility requirements, financing agreements, rebate programs, and third-party terms are separate from these Terms of Service.

Dispute resolution

If you have a concern, please contact 3 Brother's Plumbing and Heating promptly so we can review the matter. Many issues can be resolved through documentation, follow-up inspection, clarification, warranty evaluation, or communication.

Before filing a claim or initiating legal action, you agree to provide written notice describing the dispute, the service date, the property address, the invoice or estimate number if available, the amount in dispute, and the resolution requested. Unless prohibited by law, any dispute arising out of or relating to these terms, services, invoices, estimates, communications, or work performed will first be addressed through good-faith informal resolution. Governing law and venue

These terms are governed by the laws of the State of Montana, without regard to conflict-of-law rules. Unless otherwise required by applicable law, venue for disputes will be in the state or federal courts serving the county in Montana where 3 Brother's Plumbing and Heating is located or where the services were performed.

You agree that Montana law applies to these terms and to services provided by 3 Brother's Plumbing and Heating, including terms of service plumbing heating Montana customers may review before authorizing work.

Severability

If any part of these terms is found invalid, unlawful, or unenforceable, the remaining sections will remain in effect to the fullest extent permitted by law. No waiver

Failure by 3 Brother's Plumbing and Heating to enforce any provision of these terms does not waive the right to enforce that provision later. Any waiver must be in writing and apply only to the specific instance identified.

Assignment

We may assign or transfer rights and obligations related to accounts, invoices, business operations, collections, or company transactions where permitted by law.
